A Nigerian Lawyer and Public Affairs Analyst, Dr Ope Banwo has alleged that if the Edo State House of Assembly did not follow 8 legal processes before the impeachment of Philip Shaibu, he could be reinstated by the Court just like how Former Governor of Anambra State, Peter Obi was reinstated as Governor.
He argued that Shaibu’s legal strategy should hinge on scrutinizing the adherence to each of the eight processes delineated within Section 188, subsections 1 to 10.
According to him, Shaibu identifying any lapses or deviations in the assembly’s compliance with these procedures, he stands a chance of securing legal vindication and reinstatement.
He said in an interview with TVC, ”If they didn’t follow all the 8 processes under section 188, the Court will restore him [Shaibu] like Peter Obi when he was removed as Governor.
But the court did not look into whether what he [Peter Obi] did constituted to misconduct. The Court cannot do that. Section 10 of section 188 made that very clear. The Court and the Supreme Court have even ruled out that, the court cannot look into what exactly constitutes misconduct or not.
What the court can do is to review whether they followed all the processes listed in section 188. So Shaibu’s salvation now is to go gather his lawyers and then they look at the file of Section 188, subsections 1 to 10. And if there is any of them that they [the State House of Assembly] did not follow. Then he may win in court.”
The Edo State House of Assembly on Monday, impeached the embattled state deputy governor, Philip Shaibu.
The impeachment followed the adoption of the report of the seven-man investigative panel set up by the state Chief Judge to probe allegations of misconduct against Shaibu. He was probed for allegations of perjury and leaking of government secrets.
