Delta State House Assembly has recommended the reinstatement of the appointment of Mr Emmanuel Emenite which was allegedly wrongly terminated from the srevices of Post Primary Education Board(PPEB) with all promotions and financial benefits.
Mr Emenite was alleged unlawfully terminated by Post Primary Education Board (PPEB), in 2021 following report of an investigative panel which allegedly indicted him of financial dealings.
But the House committee on petition, led By Mr Edafe Emakpor, Uvwie, which reinvestigated the case follwing following Emente’s petition to Delta State House o Assembly (DTHA), thought otherwise after s thorough consideration.
According to the committee the alleged unlawful termination of Mr Emenite’s appointment in the year 2021 offended section 36(1), (doctrine of fair hearing), as enshrined in the constitution of the federal republic of Nigeria.
According to the committee chairman in his submission, the House faulted the investigative panel which allegedly indicted Mr Emenite of financial misconducted upon which his appointment was terminated for not adhering to due process by not granting the victim opportunity to defend himself of alleged offence preferred against him to the extent that even the only witness called by the Board during the hearing corroborated the memo of the legal adviser of the board to invite the petitioner and hear his position before any action.
According to the chairman in his submission, the PPEB Board, as it were took a unilateral action in terminating the petitioners appointment without due reference to the rule of law. The detailed committee report also sited several land mark cases in consideration of the petition and their recommendations.
The committee among other things, also recommended that Mr Emenite should be paid all his emoluments from the year of termination of his appointment till date.
During the consideration of the petition the chairman, PPEB, his place of last posting and other directors in the office before termination and the Head Of Service were invited for their input.
Majority of members of the legislature spoke in favor of the report and concluded that the action of the Board was in flagrant violation of the rule of law and so were in support of the recommendations of the report of the House committee on petitions Mr Emenite be reinstated with full benefit.
When the Speaker, Emomotimi Guwor put the recommendations to vote, it was unanimously passed by majority voice vote. He therefore, directed the Clerk to communicate the appropriate authorities with the resolutiion of the House for compliance.
Also at plenary the Delta State Urban and Regional Planning Bill 2024, was read a second time and refered to appropriate committee of the House for further consideration. Details in subsequent report.
